1. Agreement to these Terms

Welcome to Galactic Rocker (galacticrocker.com) (the “Site”). These Terms of Service (“Terms”) govern your use of the Site, operated by Perfezasian (“we,” “us,” or “our”). By accessing or using the Site, you agree to these Terms. If you do not agree, please do not use the Site.

These Terms apply to every visitor, whether you stop by once or use the Site every day. A few sections below apply only if you leave a comment or click an affiliate link — and say so where they do.

2. Who may use the Site

4. Content and editorial independence

Galactic Rocker publishes reviews, interviews, features, and commentary covering music journalism and reviews. Our content reflects our own opinions and experiences, and reflects honest assessments regardless of how a product was obtained or who, if anyone, paid for placement elsewhere on the page. Content is provided for general informational purposes only and should not be treated as professional advice. Where a decision carries real risk, cost, or legal consequence — structural, restoration, financial, electrical, medical, or specialty work involving valuable or irreplaceable items — consult a qualified professional rather than relying on an article.

Prices, availability, and specifications change. We make a reasonable effort to keep them current, but any price, discount, or spec shown here may be out of date by the time you read it. Always confirm on the seller’s own page before buying.

5. User-submitted content

7. Music, media, and third-party rights

Artist names, song titles, album titles, cover artwork, and press images referenced on this Site remain the property of their respective rights holders and are used for the purposes of news reporting, criticism, and commentary. We do not host, stream, or distribute recorded music ourselves.

Audio and video embedded in our articles is served by the platform that hosts it — the rights holder’s own distribution — and is subject to that platform’s terms. We do not provide downloads of copyrighted recordings, and requests for them will be declined.

8. Intellectual property

All original content on the Site — including text, graphics, logos, layouts, photography, video, and site branding — is owned by Perfezasian or its licensors and protected by copyright and trademark law. You may not use our branding or content without written permission, except for brief quotations with clear attribution and a link back to the original page.

Third-party names, logos, and marks appearing on the Site belong to their respective owners and are used for identification and commentary. Their appearance does not imply affiliation or endorsement in either direction.

We do not guarantee that the Site will be uninterrupted, timely, secure, or error-free, that defects will be corrected, or that the Site is free of harmful components. We do not guarantee that recommendations, methods, or referred third parties will meet your needs, and results may vary based on materials, condition, skill, and other factors outside our control.

11. Limitation of liability

To the fullest extent permitted by law, Perfezasian, its owners, operators, contributors, and suppliers will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages — including lost profits, lost data, or business interruption — arising from your use of the Site, your reliance on its content, or your interactions with any third party (including affiliate merchants, game providers, and referred service providers), even if we have been advised of the possibility of such damages.

Where liability cannot be excluded entirely, our total aggregate liability to you for all claims relating to the Site is limited to the greater of the amount you paid us in the twelve months before the claim arose, or USD $100.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages, so parts of the two sections above may not apply to you. Nothing in these Terms excludes liability for fraud or for anything that cannot lawfully be excluded.

12. Indemnification

You agree to indemnify and hold Perfezasian and its owners and operators harmless from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Site, your submitted content, or your violation of these Terms or of any law or third-party right.

13. Suspension and termination

We may suspend or terminate your access to the Site, or to any feature of it, at any time and without notice, if we reasonably believe you’ve breached these Terms or that your use poses a risk to the Site or to other users. Sections that by their nature should survive — intellectual property, disclaimers, limitation of liability, indemnification, and governing law — survive termination.

14. Changes to the Site or these Terms

We may modify, suspend, or discontinue any part of the Site at any time. We may also update these Terms; when we make a material change, we’ll revise the date at the top of this page. Continued use of the Site after changes are posted constitutes acceptance of the revised Terms. If you don’t accept them, stop using the Site.

15. Governing law and disputes

These Terms are governed by the laws of the State of Texas, USA, without regard to conflict-of-law principles. You and we agree that the state and federal courts located in Texas have exclusive jurisdiction over any dispute arising from these Terms or the Site, and you consent to personal jurisdiction there — except where applicable consumer protection law gives you the right to bring a claim in your own place of residence.

Before filing anything, please email us and give us 30 days to resolve it directly. Most problems turn out to be fixable with a conversation.

16. Severability and entire agreement

If any provision of these Terms is found unenforceable, that provision is limited or severed to the minimum extent necessary and the rest remains in full force. Our failure to enforce a provision isn’t a waiver of it. These Terms, together with our Privacy Policy, Cookie Policy, Affiliate & Review Disclosure, and DMCA & Copyright Policy, are the entire agreement between you and us regarding the Site.
